www.acizemwatches.com (the “Site”) is the official website for ACIZEM Watches (the “Seller”). We encourage you to read the following terms governing your use of and purchase of products from the Site. By using the Site or by providing Personal Information to us, you agree to be bound by these Terms of Use set forth below, the Cookie Policy and Terms of Sale, and any other documents referred to therein (collectively, the “Terms”).

Terms of Sale

All product sales from the Site are governed by the Returns & Exchanges policy and the Shipping Information that is posted on the Site. You should refer to such policies and review the same. By ordering and/or accepting delivery of the products, you agree to be bound by said policies.  The policies are subject to change without notice and you review the same before you purchase any product. 

The Seller undertakes the highest effort to assure that the terms and conditions of sale will form customers' rights and obligations in accordance with good practices and taking into consideration customers' interests. The customer should familiarize himself or herself with Terms of the Site, as completing a purchase will be deemed to be that he or she is in acceptance with the Terms of the Site.

Modifications to these Terms

From time to time, we may change the terms that govern your use of our Site. Your use of our Site following any such changes to these Terms of Use constitutes your agreement to follow and be bound by the terms as changed.

Terms of Payment

We use PayPal and Shopify Payments to process payments, so our staff is unable to see your payment details. PayPal is the world's largest and most secure payment provider. We accept PayPal, credit/debit cards (Visa, MasterCard, American Express), Apple Pay and Google Pay. If you have a PayPal account, but you are having problems with sending money or logging into PayPal, please contact PayPal customer service. We don’t accept the service for cash on delivery (COD). We process orders in any currency. 

Order Fulfillment 

Online store sells products on the Internet, using the website www.acizemwatches.com, on which orders may be placed. The subject of order will be further called “the Product”. The catalogue of the products is located on the Site.

The Seller currently uses Amazon Multi-Channel Fulfilment (MCF) to fulfill and deliver its Products, who may or may not use their company branded package to make the delivery. Notwithstanding the customer’s account with or knowledge of Amazon’s policies, the customer cannot contact Amazon in the situation where there are customer service issues. ACIZEM’s customer service desk is to be contacted for the quick resolutions of such issues, via their email: info@acizemwatches.com.

Orders may take between 3 and 10 business days to arrive at their destination. Occasionally, depending on various factors like customs, orders can take in excess of 10 business days to arrive. The order is dispatched within 24-48 hours after payment has been made, unless the order is a pre-order. In case of delay, please contact us by sending an e-mail to info@acizemwatches.com.

Prices

Prices of the Products are originally calculated in CAD and are thereafter converted to your chosen currency, based on the ongoing rate as stated by google. And, these are gross prices. Prices located near products do not contain information about shipping costs, unless the delivery is indicated as “free shipping”. The total order cost is presented in clear and explicit way during review, after the choice of payment and delivery had been made. Before choosing a delivery option, the customer can check delivery costs at www.acizemwatches.com/shipping. 

Sales, Custom and Value-added taxes

In an effort to remain compliant with respective consumer legislations, we strongly encourage our end customers to maintain good standing with respect to customs and value-added taxes, where applicable. Due to separate and applicable tax jurisdictions, the end customers’ purchases may be subject to specific sales, customs or value-added taxes, and the shipping time and associated cost may increase.

Privacy Policy: The Information that we Collect, the Method of Collection, and How we Use it

Personal data are processed by ACIZEM in order to use it when necessary, during your activity on our store. When you purchase our Product from the Site, as part of the buying and selling process, we collect personal information you provide us such as your name, address, and email address. More so, when you complete a purchase with us, we share your submitted shipping address, to Amazon MCF, for shipping purposes only. 

With your permission, we may send you emails and SMSs about our store, new products, promotions, and other updates. We will never sell or present personal data to any other third party. We may disclose your personal information only if we are required by law to do so or if you violate our Terms of Service.

Data Storage

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data are stored through Shopify’s data storage, databases, and the general Shopify application. They store your data on a secure server behind a firewall.

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data are stored only as long as is necessary to complete your purchase. After that is complete, your purchase transaction information is deleted.

ACIZEM does not see any credit card information.

Security of Data

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands such as Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

Warranties and Disclaimers

The Site, Submissions and content provided via the Site are provided on an “as is” and “as available” basis with no warranty of any kind. To the maximum extent permitted by law, ACIZEM disclaims all representations, warranties and conditions, express or implied with respect to the Site, Submissions, the content and any products or services, including without limitation, warranties or conditions of merchantable quality, merchantability, durability, fitness for a particular purpose, title, non-infringement, and implied warranties or conditions arising from course of dealing or performance, unless otherwise specifically set forth as an ACIZEM Guarantee.  

The material displayed on the Site is provided without any guarantees, conditions or warranties as to its accuracy. We reserve the right to revoke offers or correct errors or inaccuracies or omissions.

Limitation of Liability

To the maximum extent permitted by law, ACIZEM exclude all liability for any damages (howsoever arising, including without limitation through contract, tor (including negligence), breach of statutory duty or otherwise) arising out of or in connection with your access to (or inability to access) or use of the Site and its contents. All conditions, warranties and other terms which may be implied by statute, common law or otherwise are hereby excluded to the maximum extent permitted by law.

In no event shall the ACIZEM or their respective officers, directors, contractors, employees or agents be liable for: (i) any indirect, special, or consequential loss or damage, or (i) loss of profit, (iii) loss of business, (iv) loss of contract, or (vii) loss of data, in each case, incurred by any user in connection with the Site, any sites linked to it and any materials posted on it, even if ACIZEM has been previously advised of the possibility of such damage. Nothing in these Terms of Use shall exclude or limit our liability for death or personal injury arising from our negligence, any breach of the obligations implied by applicable law, or for any fraud, or fraudulent misrepresentation or any other liability to the extent it cannot be waived or limited under applicable law.

Governing Law and Jurisdiction

These Terms of Use shall be governed by, construed and enforced in accordance with the laws of the Province of Quebec, Canada. The courts at the registered office of ACIZEM will have exclusive jurisdiction over any claim or any dispute arising from, or related to, a visit to the Site. ACIZEM reserves the right to bring proceedings against you for breach of these Terms of Use in your State of residence or any other relevant Province.
